About the course:
There is no question that affordable housing remains an issue in Canada. In light of the high housing prices, the Federal Government has taken action to ensure residential homes in Canada are being sold to Canadian buyers by implementing the Prohibition on the Purchase of Residential Property by Non-Canadians Act (“the Act”). In effect as of 1 January 2023, the Act limits non-Canadians from purchasing residential property in Canada for a period of two years.
Join Mark Brade of Pushor Mitchell and Paul Kent of Lindsay Kenney, with moderator Bryan Fitzpatrick of Pushor Mitchell to explore the criminalization of property transfer.
Paul will provide attendees with an overview of the new offences created by sections 6(1) and (2) of the Act for assisting a non-Canadian to purchase residential property. He will share best practices to avoid being charged, including reference to the aiding and abetting provisions of the Criminal Code in relation thereto.
Mark will lead a discussion of the application of the legislation: who is affected, what properties are within the scope of the prohibition, what does “purchase” mean under the legislation, what exemptions currently exist, and what are the enforcement provisions; plus further discussion of foreseeable solicitor file work which may generate questionable applicability of the prohibition.
