Increasingly, police are choosing to forego criminal proceedings in favour of the much less onerous path of seizing and forfeiting property. In other instances, lawyers may be forced to juggle overlapping criminal and civil forfeiture proceedings simultaneously. In either case, the consequences to clients are potentially catastrophic, particularly where real property is concerned. The ongoing commission into money laundering has only increased public interest in this area and it is expected the number of civil forfeiture proceedings will continue to grow in the years to come. The panel will identify some key areas of focus, as well as provide strategies and tips for what can be a difficult, and sometimes frustrating, area of practice.
