9:00 - 11:30 am (2.5 CPD, Family Law ADR Family Violence & ADR Maintenance Credits)
About the Course:
This session will address the nuts and bolts of all stages of litigation in cases involving family violence, from drafting pleadings to trial. Topics will include protection orders and ex-parte applications, exemptions from mandatory steps, preparing your client to testify at examinations for discovery and at trial, as well as bringing civil claims. We will address difficult topics such as dealing with dismissive attitudes towards family violence, communicating with self-representing litigants, compliance with orders in the face of safety concerns, financial constraints of the client, and litigation abuse. We will also discuss safeguards to consider when applying for orders and what to do in the all-too-common situations in which the case is not really “over” despite final orders. Whether your practice is mostly in or out of court, this session will provide a valuable toolkit for assessing your client’s options, properly advising your client, and conducting your case as effectively and safely as possible.
