About the Course:
Expert evidence is a highly effective tool to deploy at trial, but with great power comes great responsibility; stumbling out of the gate by failing to properly establish an expert's qualifications can be disastrous. Conversely, successfully challenging an expert's qualifications can disrupt an opponent's trial strategy, and put them on their heels. In this seminar, we aim to provide you with some tips and strategies to navigate expert evidence, including the basics of qualifying an expert witness and establishing the scope of their expertise, as well as ideas for probing weaknesses in a witness's credentials and techniques for keeping them out of the box.
About the Speakers:
Jonathan Desbarats
Jonathan Desbarats was called to the bar in 2006. He works primarily in criminal defence and has acted in a number of high profile, large, and complex criminal prosecutions. He has also represented clients in regulatory matters, and in civil forfeiture cases. He represents clients at all levels of court in British Columbia and in various provinces across the country, in both English and French.
Kyla Lee, Acumen Law
Kyla Lee’s practice focuses on defence of driving-related offences. Kyla is a member of the TLABC Criminal Law Committee, the Editorial Board for the Verdict, and is on the Board of Governors. Kyla represents the CBABC on the Criminal Law Executive, and formerly served on The Advocate’s Society Criminal Law Practice Group. Kyla is the CLEBC Co-Chair and on the Board of the DUIDLA. She is a UWN National Ambassador.
Grant Gottgetreu, Gottgetreu Consulting
Grant Gottgetreu retired as a police corporal in 2017. He is now a consultant who uses his expertise for both defence and Crown counsel on traffic related matters. He provides forensic analysis, expert infomation and independent testimony to present evidence before the court.
