Chief Justice Skolrood of the Supreme Court of British Columbia released his decision this morning in the Trial Lawyers Association of BC’s constitutional challenge to the Legal Professions Act. (see PDF below)
The Chief Justice has ruled in favour of the Attorney General of British Columbia, confirming that the legislative assembly has authority to determine the structure of the entity responsible for regulation of legal professions in the province – although he found that government “had offered no clear rationale for the significant changes brought about to the regulation of lawyers” and “the inability, or failure, to justify overturning 150 years of self-regulation, in the face of widespread opposition from the Bar, is notable.”
