WEBINAR ARCHIVE (75)
2020 Marriage-Like Relationships Under the Wills, Estates and Succession Act

Date: 05/12/2020

After payment is complete, the link will be sent to you by the following business day.

Presented by Dan Parlow and Dan Hepburn

This webinar addresses the kinds of relationships which qualify as “marriage-like” under WESA; how the courts approach relationships of people not living together full-time or otherwise involved in a non-convention late-life relationship; and how the proximity of the relationship may affect the potential wills variation award. The following is addressed:

  • A review of issues relating to breakups of marriage-like relationships, including what is required to sever such a relationship
  • What alternative claims exist in the event of a breakup of a relationship previously qualified as “marriage-like”
  • What time limits apply to alternative claims under WESA and Family Law Act
  • How the courts may address claims by more than one partner or former partner

The webinar will include some practice points and discussions surrounding the prosecution or defense of such wills variation claims.
